COORDINATION FOR THE PROTECTION OF THE RIGHTS OF NATIONAL MINORITIES IN THE REPUBLIC OF CROATIA

The implementation of the rights of national minorities in the Republic of Croatia is rather rigidly coordinated.

Thus, according to DECISION PROMULGATING THE CONSTITUTIONAL ACT AMENDING THE CONSTITUTIONAL NATIONAL MINORITY RIGHTS ACT, “Article 4. In Article 33, after paragraph (4), a new paragraph (5) should be added, setting out paragraphs (6), (7) and (8) as follows as follows: “(5) The bodies coordinating the councils of national minorities throughout the territory of the Republic of Croatia, as referred to in paragraph (4) of this article, are non-profit legal entities. They acquire legal personality by entering them into a register run by the ministry responsible for general administrative affairs. The working methods and financing of such coordinating bodies are regulated by law. “(6) The elected national councils of national minorities act as coordinating bodies of the councils of national minorities. (7) If it is provided for in international treaties, the coordination function with regard to national minorities may also be carried out by umbrella organizations of such minorities. “(8) The National Council of Serbia acts as the coordinating body of the Serbian minority councils throughout the territory of the Republic of Croatia and has legal personality.”

Also, Article 33 of the DECISION PROMULGATING THE CONSTITUTIONAL NATIONAL MINORITY RIGHTS ACT defines that two or more councils of national minorities created in the same local government unit, two or more councils of national minorities created in different local government units, two or more councils national minorities created in the same regional self-governing unit or two or more councils of national minorities created in different subdivisions of regional self-government may establish a coordinating council of national minorities in order to harmonize or promote common interests.

Through the coordinating council of national minorities, the councils of national minorities build coordinated positions on issues under their jurisdiction.

Councils of national minorities may authorize the coordinating council of national minorities to carry out, on their behalf, individual measures specified in Article 31 of this Constitutional Law.

Councils of national minorities in regional self-government units are considered to be established by the coordinating council of national minorities throughout the territory of the Republic of Croatia when more than half of the councils of national minorities in regional self-government units join the agreement establishing this single coordination council.
