Judicial and legal progress, despite the obvious significance of this phenomenon, remains a little-studied category today, which is often associated with some positive changes in the judicial system and its functioning, without defining, however, the determinants and essence of such changes. Usually, the authors only point out to us some positive characteristic of legal progress, implying its essence as a matter of course [1,181], although this is obviously not the case. Generalization and reviews of the author's positions allow us to assert that most authors understand legal progress as a natural process of development of society associated with qualitative, positive changes in its legal component and aimed at achieving legal goals [2,320].

Meanwhile, it is difficult to fully agree with the proposed definition. In our opinion, in this case, the legal system of society is still progressing, and even the system of law as its main part; society may even regress or remain mostly "unchanged" in terms of its indicators. In addition, legal progress may well be measured in addition to qualitative and quantitative characteristics: a decrease in the total number of crimes committed, an improvement in their detection, an increase in the amount of money recovered by bailiffs under enforcement documents, and so on. Without quantitative characteristics, it is generally impossible to assess the effectiveness and quality of the law, we can only talk about its effectiveness, that is, the degree to which the law achieves the necessary results according to the goals set. Finally, the question of the direction of legal progress towards achieving legal goals is also important.

As a result, we come to the conclusion that legal progress is a natural positive development of the legal system of society and its individual elements from its less perfect to its more perfect state. 

It is obvious that legal progress is a multifaceted and complex category, just as the legal system of society and legal life itself are complex. At the same time, we note that the sphere of judicial and legal progress cannot be designated in any way depending on the subject of legal regulation. Judicial and legal progress on the one hand and constitutional and legal (civil and other, distinguished depending on the branch of legal norms "legal progress") on the other hand, are different-order values. Of course, judicial and legal progress is characterized, first of all, by positive changes in the judicial system itself, however, in fact, judicial and legal progress is the result of coordination of various legal activities of legal entities. 

At the same time, it is currently advisable to consider separately the progressive elements of the legal system of society and the legal system itself, including their constituent elements such as judicial and legal progress. In fact, judicial and legal progress is a two-element object. On the one hand, when studying it, we should talk about improving the regulatory framework, legislative and interpretative practices governing the administration of justice. On the other hand, we should talk about increasing the effectiveness of jurisdictional judicial practice, that is, about the progressive development of the judicial system, which is directly manifested in the very activity of the courts.
