DISADVANTAGES OF THE COORDINATION LEGAL DOCTRINE IN GREECE

In our opinion, Greek law lacks a significant scientific doctrine of legal coordination. This explains both the small number of coordination standards and their low quality, as well as the shortcomings of the terminology, since in the current legislation of Greece the concept of “coordination” is constantly mixed with the categories of “cooperation”, “interaction”, “cooperation” and others.

Therefore, even in those normative legal acts where there are significant coordination norms, coordination is called otherwise.

As an example of such a situation, we indicate the following Law No. 4445 of 2016 on the National Mechanism for the Coordination, Monitoring and Evaluation of Social Integration and Social Cohesion policies, provisions regarding social solidarity, implementation of the provisions of Law No. 4387 of 2016 and other provisions [1], and also other acts [1], namely, Law No. 4430 of 2016, which constitutes the social and solidary economy, regulates the development of its entities and the introduction of other provisions; Law No. 4411 of 2016 ratifying the Council of Europe Convention on Cybercrime and its Additional Protocol on the criminalization of acts of a racist and xenophobic nature committed using computer systems; Decision to include Directive 2013/40 / EU of the European Parliament and of the Council on attacks on information systems and the replacement of Council Framework Decision 2005/222 / JHA, the introduction of corrective and criminal policies and other provisions in Greek legislation; Law No. 4403 of 2016 on the harmonization of Greek law with the provisions of Articles 19, 20, 29, 30, 33, 35 and 40-46 of Directive 2013/34 / EC on annual financial statements, consolidated financial statements and related reports, some types of obligations that introduce amendments to Directive 2006/43 / EC of the European Parliament and of the Council and repealing Council Directives 78/660 / EEC and 83/349 / EEC (06.29.2013) and the provisions of Directive 2014/95 / EC of the European Parliament and of the Council (15.11.2014), amending Directive 2013/34 / EC with regard to the disclosure of non-financial and comprehensive information by certain large enterprises and groups and other provisions falling under the jurisdiction of the Ministries of Finance, Development and Tourism.

All of these regulatory legal acts distort the original meaning of the category “coordination”. This term is also called interdepartmental cooperation, and cooperation and other forms of interaction.

Since the coordination mechanism differs sharply from the mechanism, for example, cooperation, difficulties in the implementation of these norms can potentially arise in practice.

The aforementioned circumstance impedes effective legal regulation and does not allow to use the whole huge potential of the procedures for coordinating the interests of various parties.

At the same time, a misinterpretation of the norms of the law may violate the rights of an indefinite number of people who are somehow involved in state legal procedures.
